OFFICIAL FESTIVAL RULES
The Jack’d Film Festival is committed to creating an inclusive, respectful, and welcoming environment for filmmakers, audiences, judges, partners, and participants.
Submissions may not contain content that promotes, endorses, or encourages discrimination, harassment, hate, Child Sexual Abuse Material (CSAM), beastiality, or demeaning treatment based on race, ethnicity, nationality, religion, sex, gender, gender identity or expression, sexual orientation, disability, age, or other protected characteristics.
Films containing hateful, discriminatory, defamatory, or derogatory material may be deemed ineligible or removed from consideration at the discretion of the Jack’d Film Festival.
The festival recognizes that filmmakers may address difficult or sensitive subjects, including discrimination and prejudice, when presented within a legitimate narrative, documentary, educational, historical, or artistic context.
By submitting your film to this festival, you acknowledge that you have read, understood, and agree to be bound by the Festival Rules & Terms and Conditions. Your submission constitutes acceptance of these terms.

INTRODUCTION
The Jack’d Film Festival is operated by Perry Street Software, Inc. and its affiliates (“Festival”). These Official Festival Rules (“Rules”) govern eligibility, participation, programming, exhibition, judging, awards, audience voting, content standards, and Festival operations. Participation in the Festival constitutes acceptance of these Rules, the Submission Terms and Conditions, and any Participation & Exhibition Agreement executed by the filmmaker. Festival reserves the right to interpret, apply, modify, and enforce these Rules in its sole discretion. All Festival decisions are final and binding. -
ELIGIBILITY
Festival may establish eligibility requirements relating to: production completion dates; running time; format; language; country of origin; premiere status; subject matter; category designation; filmmaker qualifications. Festival may modify eligibility criteria at any time. Festival reserves the right to determine eligibility in its sole discretion and submission does not guarantee selection. -
SUBMISSION REQUIREMENTS
Submitted Films must: be submitted by an authorized rights holder; comply with applicable law; comply with Festival technical requirements; include all requested materials; include accurate submission information. Festival may reject incomplete submissions and/or may request additional information or documentation. -
CONTENT STANDARDS
Festival supports artistic expression and diverse viewpoints. However, Festival reserves the right to reject, remove, suspend, or disqualify any Film that includes or promotes: (i) unlawful conduct; child sexual abuse material; unlawful obscenity; unlawful hate speech; unlawful harassment; unlawful discrimination; unlawful threats; unlawful violence; or (ii) infringes copyrights; infringes trademarks; violates publicity rights; violates privacy rights; misappropriates confidential information; or creates significant: legal risk; regulatory risk; safety risk; reputational risk; platform integrity concerns; or (iii) contains: nonconsensual intimate imagery; exploitation; unauthorized use of likenesses; deceptive synthetic media violating applicable law. Festival retains sole discretion regarding compliance with these standards. -
PROGRAMMING AND EXHIBITION
Festival shall determine, in its sole discretion: which Films are selected; screening schedules; screening venues; screening formats; streaming availability; category placement. In addition, Festival may: add screenings; cancel screenings; move screenings; modify schedules; create virtual screenings; create encore screenings. -
DIGITAL EXHIBITION
Selected Films may be made available through: the Jack’d mobile application; Festival websites; Festival streaming platforms; Festival partners. Streaming availability may vary by: territory; region; device; category; rights availability. -
AUDIENCE CHOICE AWARD VOTING
Festival may conduct audience voting through Jack’d and other designated platforms. Festival reserves the right to establish: voting periods; eligibility requirements; vote limits; and voting procedures. The following are prohibited: automated voting; bots; vote manipulation; vote buying; vote exchanges; creation of fake accounts; fraudulent activity; and circumvention of technical safeguards. Festival may investigate any voting activity including, but not limited to, review account activity; review technical data; review device information; review voting patterns; and/or conduct audits. Festival may: invalidate votes; remove votes; disqualify Films; and revoke awards. For the avoidance of doubt, no notice is required before disqualification. Festival’s determinations regarding voting, eligibility, vote counts, and awards are final and binding. Further, no appeals shall be permitted. -
JUDGING
Festival may appoint judges, juries, reviewers, programmers, or advisory panels. Judges may consider: artistic merit; storytelling; originality; technical execution; relevance; audience impact; and other factors deemed appropriate. Festival is not obligated to disclose scoring methodologies and all judging decisions are final. -
AWARDS
Festival may present: jury awards; audience awards; category awards; sponsor awards; special recognition awards. In addition, Festival reserves the right to: modify categories; combine categories; split categories; and/or withhold awards. Further, awards may be revoked if eligibility issues arise. -
PROMOTION AND PUBLICITY
Festival may use: film titles; filmmaker names; production company names; biographies; photographs; stills; posters; trailers; approved clips; and award information. Such use may occur in: advertising; social media; websites; press releases; sponsor materials; and future Festival promotions. Also, no compensation shall be owed for such use. -
MEDIA COVERAGE
Festival may photograph, record, livestream, broadcast, and otherwise document: screenings; Q&A sessions; panels; red carpet events; award ceremonies; and/or filmmaker appearances. By way of these Rules, Participants grant permission for such uses. -
COPYRIGHT CLAIMS
Festival reserves the right to: remove content; suspend exhibition; request documentation; investigate claims. Festival may act upon: copyright complaints; trademark complaints; publicity-right complaints; court orders; takedown notices. -
REMOVAL OF FILMS
Festival may remove a Film at any time if: rights ownership is disputed; information is inaccurate; legal claims arise; policies are violated; security concerns arise; reputational concerns arise. All removal decisions are final. -
NO COMPENSATION
Participation in the Festival does not entitle filmmakers to: exhibition fees; royalties; license fees; revenue sharing; sponsorship revenue; and advertising revenue. Unless otherwise agreed in writing, no compensation shall be paid. -
LIMITATION OF LIABILITY
Festival shall not be liable for: piracy; unauthorized copying; data loss; technical failures; transmission interruptions; streaming interruptions; voting irregularities; award determinations; and programming decisions. In addition, Festival’s aggregate liability shall be limited to the maximum extent permitted by law. -
RESERVATION OF RIGHTS
Festival reserves the right to: modify Festival operations; amend Rules; cancel categories; modify awards; postpone events; cancel events; convert events to virtual formats; suspend participation. Such actions may occur without liability. -
FORCE MAJEURE
Festival shall not be liable for delays, interruptions, modifications, or cancellations caused by events beyond its reasonable control, including: natural disasters; public health emergencies; governmental actions; labor disputes; technology failures; cyber incidents; acts of terrorism; civil unrest. -
GOVERNING LAW AND DISPUTES
These Rules shall be governed by the laws of the State of Florida without regard to conflict of law principles. Any dispute relating to the Festival shall be resolved exclusively through confidential binding arbitration administered by JAMS in the State of Florida. Participants waive any right to: jury trial; class action participation; and representative proceedings.
FESTIVAL COMMUNITY STANDARDS AND CONTENT POLICY

PURPOSE
The Jack’d Film Festival (“Festival”) is committed to supporting artistic expression, diverse voices, and meaningful storytelling while maintaining a safe, lawful, and respectful environment for participants, viewers, sponsors, partners, and community members. This Community Standards and Content Policy (“Policy”) applies to: submitted films; trailers; promotional materials; still images; artwork; filmmaker profiles; panel discussions; Festival events; digital exhibition through the Jack’d application and related Festival platforms. Festival reserves the right to interpret and enforce this Policy in its sole discretion and nothing in this Policy obligates Festival to exhibit, retain, or distribute any content. -
GENERAL PRINCIPLES
Festival values: artistic freedom; creative expression; cultural diversity; LGBTQ+ representation; political expression; social commentary; documentary storytelling. However, participation is a privilege and not a right. Festival may decline, remove, restrict, suspend, or terminate participation where necessary to protect users, comply with law, preserve platform integrity, or manage legal and reputational risks. -
PROHIBITED CONTENT
The following content is prohibited: (i) any content involving child sexual abuse material; sexual exploitation of minors; grooming; trafficking of minors; (ii) revenge pornography; nonconsensual intimate imagery; secretly recorded sexual activity; unauthorized distribution of intimate content; manipulated intimate imagery depicting real persons without consent; (iii) unlawful violence; criminal solicitation; terrorist activity; human trafficking; unlawful drug trafficking; unlawful weapons trafficking; fraud schemes; (iv) content that infringes copyrights; infringes trademarks; misappropriates trade secrets; violates publicity rights; violates privacy rights; or (v) content primarily intended to: harass; threaten; intimidate; dox; target individuals for abuse. -
ADULT CONTENT
Festival recognizes that films may include mature themes, sexuality, nudity, and intimate subject matter. Adult content may be permitted when presented within legitimate artistic, documentary, educational, journalistic, historical, or narrative contexts. Festival may impose: age restrictions; content warnings; geographic restrictions; screening limitations. Festival reserves the right to determine appropriate classifications. -
HATEFUL OR EXTREMIST CONTENT
Festival prohibits content whose primary purpose is to: promote hatred; promote violence; encourage discrimination; glorify extremist organizations; advocate unlawful violence against protected groups. Festival may permit documentary, educational, historical, journalistic, or critical depictions where appropriate context exists. -
PRIVACY AND PUBLICITY RIGHTS
Participants must secure all necessary permissions relating to: likeness rights; voice rights; publicity rights; privacy rights; location rights. Festival may request evidence of releases or permissions. Failure to provide requested documentation may result in removal or disqualification. -
AI-GENERATED AND SYNTHETIC CONTENT
Where a Film includes material generated or materially altered using artificial intelligence technologies, participants represent and warrant that: all applicable laws have been followed; no unauthorized use of voice or likeness occurred; no deceptive synthetic media violates applicable law; all necessary permissions have been obtained. Festival may require disclosure of AI-generated content. Festival may request additional information regarding AI usage. -
CONTENT WARNINGS
Festival may assign content warnings, including warnings relating to: violence; sexual content; nudity; substance abuse; self-harm; suicide; flashing imagery; sensitive subject matter. Festival retains sole discretion regarding warnings and classifications. -
DIGITAL PLATFORM INTEGRITY
Participants shall not engage in conduct intended to manipulate Festival systems, including: vote manipulation; automated voting; account farming; bots; fake engagement; or technical interference. Violations may result in: disqualification; removal of content; revocation of awards; and/or future participation bans. -
INVESTIGATIONS
Festival may investigate potential violations of this Policy. Festival may: request documentation; request explanations; suspend participation; remove content; restrict access. Festival is not required to provide advance notice. -
ENFORCEMENT ACTIONS
Festival may take any action it reasonably determines appropriate, including: content removal; content restriction; suspension; disqualification; award revocation; account restrictions; permanent exclusion from future Festivals. Festival decisions are final. -
SPONSOR AND PLATFORM CONSIDERATIONS
Festival may consider: sponsor obligations; platform obligations; regulatory obligations; legal risk; reputational concerns; when making content moderation decisions. Festival shall have no obligation to exhibit content that creates material risk to Festival operations. -
NO OBLIGATION TO EXHIBIT
Selection does not guarantee exhibition as Festival reserves the right to remove or discontinue exhibition at any time. No compensation shall be owed as a result of such decisions unless expressly agreed in writing. -
RESERVATION OF RIGHTS
Festival reserves the right to amend, interpret, apply, and enforce this Policy in its sole discretion. All Festival determinations under this Policy are final and binding. This Policy is intended to supplement, and not limit, the rights and remedies available to Festival under applicable agreements, rules, policies, or law.
FILM FESTIVAL SUBMISSION TERMS AND CONDITIONS
These Film Festival Submission Terms and Conditions (“Submission Terms”) govern the submission of audiovisual works (“Films”) to the Jack’d Film Festival (the “Festival”), operated by Perry Street Software, Inc. and its affiliates (“Festival Parties”). By submitting a Film, the submitter (“Filmmaker”) agrees to these Submission Terms.

Eligibility
The Festival is open to eligible filmmakers and rights holders who have the authority to submit a Film and grant the rights described herein. The Festival reserves the right to establish eligibility requirements relating to production date, running time, subject matter, language, premiere status, geographic origin, and category designation. The Festival may reject, suspend, disqualify, remove, or revoke participation of any Film at any time, in its sole discretion. -
Submission Materials
Filmmaker shall provide all materials requested by the Festival, including, but not limited to: film screener, synopsis, credits, cast/crew information, promotional artwork, still images, trailer, contact information, and category information. In addition, Filmmaker represents that all information submitted is accurate and complete. -
Selection
A submission does not in any way guarantee selection. The Festival reserves sole discretion regarding: selection decisions, programming decisions, screening schedules, categories, and awards eligibility. The Festival decisions shall be in its sole discretion and final. -
Promotional License
By submitting a Film, Filmmaker grants the Festival a worldwide, royalty-free license to use, reproduce, distribute, display, publish, and otherwise exploit submitted promotional materials, including, but not limited to: film title, synopsis, stills, posters, artwork, trailer, cast and crew information, and press materials for purposes of evaluating submissions and promoting the Festival. -
Representations and Warranties
Filmmaker represents and warrants that: (a) filmmaker owns or controls all rights necessary for submission and exhibition of the Film; (b) all copyrights, music rights, synchronization rights, master recording rights, trademark rights, publicity rights, and other rights have been obtained; (c) appropriate releases and consents have been secured from all persons appearing in the Film where required; (d) the Film does not infringe any third-party intellectual property rights; (e) the Film does not violate any applicable law; (f) the Film does not contain defamatory material; and (g) the Film does not contain unlawful obscenity, child sexual abuse material, non-consensual intimate imagery, or other unlawful content. -
Indemnification
Filmmaker shall defend, indemnify, and hold harmless Perry Street Software, Inc., the Festival, sponsors, partners, judges, employees, officers, directors, agents, contractors, representatives, successors, and assigns from all claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from: the Film; submission materials; breach of these Submission Terms; alleged infringement; alleged violation of privacy or publicity rights. -
Limitation of Liability
Under no circumstances shall any Festival Party be liable for indirect, incidental, consequential, punitive, or special damages arising from participation in the Festival. Festival liability shall not exceed submission fees actually paid. -
Governing Law and Arbitration
These Submission Terms shall be governed by Florida law without regard to conflict of law principles. Any dispute arising from these Submission Terms shall be resolved exclusively through confidential binding arbitration administered by JAMS in the State of Florida. All class actions are expressly waived by Filmmaker.
FESTIVAL STREAMING TERMS ADDENDUM
This Jack’d Festival Streaming Terms Addendum (“Streaming Addendum”) supplements the Film Festival Participation and Exhibition Agreement and governs the digital exhibition of Films through the Jack’d mobile application and other authorized Festival streaming platforms. In the event of a conflict between this Streaming Addendum and any other Festival document, this Streaming Addendum shall control with respect to digital exhibition matters.

Grant of Streaming Rights
Filmmaker grants Festival a limited, non-exclusive, worldwide, royalty-free license during the Festival Streaming Period to: (a) host, store, reproduce, encode, transcode, cache, display, perform, stream, transmit, and make available the Film through the Jack’d application and authorized Festival platforms; (b) create temporary and technical copies reasonably necessary for digital exhibition; (c) distribute encrypted versions of the Film to content delivery networks and technology vendors engaged by Festival; (d) make the Film available to authorized Festival viewers. All rights granted are non-exclusive and ownership of the Film remains exclusively with Filmmaker. -
Festival Streaming Period
Festival may make the Film available during the Festival Streaming Period designated by Festival (the “Streaming Period”). Festival may modify the Streaming Period for operational, legal, technical, or programming reasons. Upon expiration of the Streaming Period, Festival shall discontinue public access to the Film except as required for backup, archival, legal compliance, or technical purposes. -
Security Measures
Festival may implement commercially reasonable security measures, including: digital rights management (DRM); watermarking; encryption; access controls; authentication systems; session management; device restrictions; geoblocking; and content delivery protections. Festival reserves discretion regarding the specific technologies employed. -
Acknowledgment of Digital Risks
Filmmaker acknowledges that: (a) no streaming platform can completely eliminate piracy; (b) unauthorized copying, recording, downloading, screen capture, or redistribution may occur; (c) security technologies are designed to reduce, but cannot eliminate, such risks. Filmmaker accepts these inherent risks as a condition of participation. -
Anti-Piracy Response
Upon learning of unauthorized distribution, Festival may, but is not obligated to: investigate the matter; issue takedown requests; submit DMCA notices; restrict access; suspend streaming; pursue enforcement efforts. Festival shall determine appropriate responses in its sole discretion. -
Technical Interruptions
Festival does not guarantee: uninterrupted availability; platform uptime; viewer access; bandwidth performance; device compatibility. Accordingly, technical failures shall not constitute a breach of Festival obligations. -
Third-Party Providers
Festival may engage third-party vendors, cloud providers, streaming providers, content delivery networks, analytics providers, cybersecurity vendors, and related service providers. Festival may share Film files and related metadata with such providers as reasonably necessary to facilitate streaming operations. -
Limitation of Liability
Festival shall not be liable for: piracy; unauthorized copying; unauthorized downloads; unauthorized recordings; cyberattacks; security breaches not caused by Festival’s gross negligence or willful misconduct; platform outages; technical failures; loss of business opportunities; lost profits. Under no circumstances shall Festival be liable for consequential, indirect, incidental, punitive, or special damages. -
No Revenue Sharing
Streaming through Jack’d shall not entitle Filmmaker to: royalties; revenue participation; advertising revenue; subscription revenue; sponsorship revenue; exhibition fees; unless otherwise expressly agreed in writing. -
Reservation of Rights
Festival may remove, suspend, or restrict access to any Film at any time if Festival determines that: legal concerns exist; rights ownership is disputed; platform policies are implicated; security concerns arise; regulatory concerns arise; reputational concerns arise. Festival decisions shall be final.
FESTIVAL COPYRIGHT COMPLAINT AND DMCA POLICY
Perry Street Software, Inc. and the Festival respect the intellectual property rights of others and expect participants to do the same. This Copyright Complaint and DMCA Policy applies to all Festival submissions, exhibitions, and digital streaming activities.

Copyright Compliance
All filmmakers are responsible for obtaining all rights, licenses, permissions, releases, and clearances necessary for submission and exhibition of their Films. Accordingly, participation in the Festival does not relieve filmmakers of any copyright obligations. -
Reporting Copyright Infringement
Any person who believes that content exhibited through the Festival infringes copyright may submit a written notice containing: identification of the copyrighted work; identification of the allegedly infringing material; contact information; a statement of good faith belief that the use is unauthorized; a statement under penalty of perjury that the information provided is accurate; a physical or electronic signature. Notices shall be submitted to the Festival’s designated copyright agent. -
Festival Response
Upon receipt of a facially valid complaint, Festival may: remove content; disable access; suspend exhibition; request additional information; investigate the claim. Festival may take such action without prior notice to the Filmmaker. -
Counter-Notice Procedure
Where appropriate, Festival may permit the submission of a counter-notice containing information required under applicable law. Festival reserves discretion regarding whether and when content may be restored. -
Repeat Infringers
Festival reserves the right to: disqualify participants; remove Films; prohibit future participation; revoke awards; where repeated infringement claims or violations occur. -
Ownership Disputes
Where ownership of a Film or any portion thereof becomes disputed, Festival may immediately: suspend exhibition; remove streaming access; freeze award eligibility; require supporting documentation. Festival may maintain suspension until the dispute is resolved to Festival’s satisfaction. -
Cooperation
Participants shall cooperate fully with Festival investigations relating to: copyright claims; trademark claims; publicity-right claims; ownership disputes; licensing disputes. Failure to cooperate may result in disqualification. -
Reservation of Rights
Festival reserves all rights and remedies available under applicable law and may take any action it reasonably determines is necessary to protect itself, its users, sponsors, partners, and stakeholders. -
No Duty to Adjudicate
Festival is not a court and is not obligated to adjudicate ownership disputes or determine ultimate legal rights between competing claimants. Also, Festival may act conservatively to mitigate risk while disputes remain unresolved.
FILM FESTIVAL PARTICIPATION AND EXHIBITION AGREEMENT
This Film Festival Participation and Exhibition Agreement (“Agreement”) is entered into between Perry Street Software, Inc. (“Festival”) and the filmmaker, producer, production company, or authorized rights holder identified in the submission materials (“Filmmaker”).

Film
This Agreement applies to the film submitted by Filmmaker to the Festival, as identified in the applicable submission materials (the “Film”). -
Grant of Exhibition Rights
Filmmaker grants Festival a limited, non-exclusive, worldwide, royalty-free license during the period designated by Festival for exhibition of the Film (the “Festival Period”) to: (a) publicly perform and exhibit the Film at Festival venues; (b) publicly perform and exhibit the Film at Festival-affiliated screenings and events; (c) digitally exhibit, stream, transmit, host, display, reproduce, encode, store, cache, and make available the Film through, but not limited to: the Jack’d application; festival websites; festival streaming platforms; other Festival distribution channels; (d) create technical copies necessary to facilitate exhibition and streaming. Notwithstanding the foregoing, all rights granted are non-exclusive and ownership of the Film remains with Filmmaker. -
Promotional Rights
Festival may use: title, synopsis, cast information, crew information, posters, stills, artwork, trailers, and excerpts from the Film. Such materials may be used worldwide for: advertising, publicity, marketing, social media, press relations, sponsor presentations, archival records without additional compensation. -
Audience Voting
Festival may conduct audience voting through Jack’d or other designated platforms and shall have the right to audit votes; investigate voting activity; invalidate votes; disqualify participants; modify procedures to preserve integrity. Festival determinations regarding voting and awards are final and binding. -
Awards
Eligibility for awards shall be determined under the Official Festival Rules. Further, Festival reserves the right, in its sole discretion: not to present an award; modify categories; revoke awards based on later-discovered violations. -
Security and Anti-Piracy
Festival may implement: DRM, encryption, watermarking, geo-blocking, access controls, authentication measures. Notwithstanding the foregoing, Filmmaker acknowledges that no security system is completely secure. Accordingly, Festival does not guarantee against unauthorized copying, screen recording, downloading, redistribution, or piracy. -
No Compensation
Participation in the Festival is strictly voluntary. Accordingly, unless expressly agreed in writing: no exhibition fee shall be owed; no license fee shall be owed; no royalties shall be owed; and no revenue sharing shall be owed. -
Content Standards
Filmmaker represents that the Film complies with Festival content standards and applicable law. Festival reserves the right to remove or suspend Films that present legal, safety, policy, or reputational concerns. -
Representations and Warranties
Filmmaker repeats and reaffirms all representations contained in the Submission Terms and further warrants that all exhibition rights granted herein remain valid through the Festival Period. -
Indemnification
Filmmaker shall defend, indemnify, and hold harmless Festival from all claims arising from: exhibition of the Film; streaming of the Film; intellectual property claims; publicity/privacy claims; and any breach of this Agreement. -
Limitation of Liability
Festival shall not be liable for: piracy; unauthorized copying; technical failures; transmission interruptions; voting irregularities; award determinations; cancellation or modification of Festival events. Notwithstanding anything contained herein to the contrary Festival’s aggregate liability shall not exceed $1,000. -
Force Majeure
Festival may modify, postpone, relocate, convert to virtual exhibition, or cancel Festival activities due to events beyond reasonable control. -
Governing Law and Arbitration
This Agreement shall be governed by Florida law. Any dispute shall be resolved through confidential binding arbitration administered by JAMS in the State of Florida. -
Entire Agreement
This Agreement, together with the Submission Terms and Official Festival Rules, constitutes the entire agreement between the parties.
